Terms of Service
These terms govern use of uppswim.com and purchases of swimwear through this store. In these terms, "we", "us", and "our" refer to the operator of uppswim.com. Contact us at support@uppswim.com. Please read these terms together with our Shipping Policy, Returns, Refunds & Exchanges policy, and Privacy Policy.
1. Eligibility & Lawful Use
You must have legal capacity to enter into a purchase contract under the law that applies to you. Do not use the store for unlawful activity, payment fraud, unauthorized access, malicious code, or infringement of another person’s rights. Optional marketing or cookie consent is separate from acceptance of purchase terms.
2. Product Information & Fit
We aim to describe swimwear accurately, including sizes, materials, care information, and features on individual product pages. Consult the size chart for the particular style. Screen settings and lighting may affect how colors appear, but this does not excuse a material mismatch with the description. Features such as UV protection, chlorine resistance, shaping, or recycled content apply only when expressly stated and supported for that product.
3. Prices, Shipping & Taxes
Prices and shipping charges are stated in U.S. dollars unless a different checkout currency is expressly shown. Standard shipping is FREE on orders of US$89.00 or more and US$9.99 on orders below US$89.00. VIP Express Shipping costs US$19.99 per order, including orders that qualify for free standard shipping. The free-shipping threshold is based on the merchandise subtotal after discounts, excluding shipping, taxes, and duties. Taxes and import charges are handled as described before purchase and in the Shipping Policy. The total payable is shown before you submit payment. An optional upgrade requires your choice.
4. Orders & Payment
Check item details, sizes, quantities, delivery information, and the total before submitting an order. Use only payment methods you are authorized to use. The payment methods actually available are those displayed at checkout. An automated order-receipt email acknowledges the order. We accept an order when we send a dispatch confirmation, unless applicable law or an express checkout statement provides otherwise. If payment has been taken and we cannot accept or fulfill the order, we will promptly refund the affected amount.
5. Errors & Stock Availability
If a material pricing, description, or stock error affects your order, we will notify you and offer a correction for your agreement or a cancellation and refund. We will not substitute an item or increase an accepted price without your agreement. Availability and promotional changes apply prospectively and do not remove rights under an existing contract.
6. Delivery
Typical processing is 1–3 business days, with estimated transit of 6–8 business days for standard shipping or 3–7 business days for VIP Express Shipping after dispatch, unless another estimate is clearly stated before purchase. See the Shipping Policy for availability, tracking, delays, and customs. If we cannot ship within the stated period, we will give the notice, cancellation options, and refunds required by law. Any mandatory rules on delivery deadlines and transit risk take priority.
7. Returns, Cancellation & Faulty Goods
Our voluntary 30-day return offer and the swimwear hygiene conditions are set out in the Returns, Refunds & Exchanges policy. Those conditions do not remove mandatory cancellation, conformity, warranty, or defect rights. Any permitted final-sale restriction must be clearly disclosed before purchase and cannot exclude statutory rights. Dispatch does not prevent a valid statutory cancellation notice.
8. Accounts & Communications
Keep account access information confidential and provide accurate order and contact details. Tell us promptly if you suspect misuse. We send transaction-related messages needed to manage purchases. You can unsubscribe from marketing messages separately. We may restrict access proportionately for fraud, security issues, or a serious breach, subject to applicable law and existing order obligations.
9. Intellectual Property & Customer Content
Website content is owned by us or used with permission where applicable. No ownership of third-party rights is claimed. You may use the site for personal shopping and other uses permitted by law. If you submit a review or product photo, you confirm you have the necessary rights. You retain ownership and give us a non-exclusive permission to display and format that submission for the purpose for which it was provided. Any broader advertising use requires an appropriate separate permission. We may remove unlawful or abusive content but do not suppress a review simply because it is negative.
10. Third-Party Services
Checkout, payment, delivery, and external websites may involve third parties with their own terms and privacy notices. Review those notices where relevant. Third-party involvement does not remove our obligations to you as the seller.
11. Privacy
Our Privacy Policy explains how personal information is handled and how to exercise rights. Where consent is legally required for optional processing, it is requested separately. Merely browsing or placing an order does not waive privacy rights.
12. Liability & Consumer Rights
We remain responsible for obligations imposed by applicable law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including fraud, fraudulent misrepresentation, death or personal injury caused by negligence where applicable, or mandatory consumer rights. Any lawful limitation applies only to the extent permitted in your jurisdiction. We do not require consumers to waive statutory warranties or accept goods on an overriding "as is" basis.
13. Complaints & Applicable Law
Email support@uppswim.com with your order number and a description of the issue so we can work toward a resolution. The applicable law and competent courts are determined by the rules that apply to the transaction. Nothing in these terms deprives you of mandatory protections in your country of habitual residence or any right to bring a claim in a court available to you under applicable law. These terms do not impose mandatory arbitration or a class-action waiver.
14. Changes, Severability & Contact
Changes to these terms apply to future use and orders after publication. The version in effect when your order was placed governs that order unless a lawful change is expressly agreed. If a provision is unenforceable, the remainder continues where legally possible.
